Ferndale man accused of shooting car in road rage incident on Main Street

FERNDALE, Wash. — A Ferndale man was arrested after being accused of shooting a hole in a car containing 4 people during what victims called a road rage incident.

According to the probable cause statement submitted to Whatcom County Superior Court by Ferndale Police, shortly after 7pm on Friday, September 20th, police were dispatched to a report of a road rage incident with shots fired. A Ferndale Police officer made contact with the victims who said the suspect had shot at them in their car at the intersection of Main Street and Hendrickson Avenue. They said the suspect then drove north on Hendrickson Avenue.

The officer said in his statement he located a bullet hole in the passenger side door and a bullet laying on the floor mat of the front passenger seat.

A press release from the Police Department stated the victim’s vehicle “was occupied by a 19 year old male driver, and three juvenile male passengers.”

The victims gave police a description of the suspect and of a white BMW with a black spoiler and accents, descriptions the police officer said he was familiar with from a prior case. The officer had also been led to believe from information received in the other case that the suspect kept a handgun in his car.

The officer said he made contact with the suspect, identified as Rosalio L. Todd, age 21, at the suspect’s residence. Others in the residence said he had recently arrived home from work. The timing fit the time frame of the reported shooting incident according to the officer’s statement. The victims confirmed to the officer that Todd’s car was the same as the one from the shooting incident.

Todd was arrested on suspicion of 1st degree assault. A search warrant was obtained and a search of Todd’s car turned up a handgun thought to have been used in the incident according to Ferndale Police.

According to jail records, Todd was released yesterday evening after posting a $10,000 bail. He is scheduled to be arraigned Friday, September 27th. The court also ordered he immediate surrender any other weapons to Ferndale Police.
