Jail records indicate a Ferndale man remained in custody today, January 7th, after being arrested early yesterday following a high-speed pursuit that resulted in the van he was in ending up in a water-filled ditch.
According to affidavits of probable cause filed in Whatcom County Superior Court, the suspect, Shawn E Sivo, age 38, of Ferndale, was a suspect in an assault at a Ferndale address reported on November 23, 2020 and suspected to have been in a possession of a vehicle reported stolen in Bellingham on December 29, 2020.
On the evening of Tuesday, January 5th, law enforcement received information regarding Sivo’s location and, according to an affidavit filed with the court, around 11:45pm that night Whatcom County Sheriff’s Office (WCSO) deputies encountered Sivo driving a blue van at a high rate of speed in the 7100 block of Valley View Road. Uniformed WCSO deputies and a Washington State Patrol trooper in marked vehicles attempted to stop the van with their emergency lights and sirens activated. Instead of stopping, the van, fled at speeds of over 70mph during a pouring rain.
The pursuit, according to unconfirmed law enforcement radio transmissions at the time, led law enforcement down Bay Road to Vista Drive, then onto Delta Line Road.
The trooper was able to perform a PIT maneuver and the van spun out and ended up in a ditch according to an affidavit. According unconfirmed radio transmissions at the time, the pursuit ended on Delta Ring Road and the van was half-submerged in water.
Sivo and a passenger were both taken into custody without incident.
The passenger reported Sivo had tossed a bag out of the van during the pursuit. Deputies located the bag and it contained a stolen handgun and ammunition along with 11.6 grams of suspected heroin and 19 grams of suspected methamphetamine.
Sivo was arrested and booked into the Whatcom County Jail shortly after midnight by deputies. According to jail records, he was charged with suspicion of:
- reckless driving
- possession of a controlled substance
- unlawful possession of a firearm
- 2nd-degree assault
- possession of a stolen vehicle
- possession of a stolen firearm
- 1st-degree of driving while license suspended (2 counts)\
- attempting to elude a police vehicle
According to an affidavit, Sivo is a 13-time convicted felon with convictions for vehicular assault, unlawful possession of a firearm, assault, residential burglary, attempting to elude a police vehicle and possession of a controlled substance. He had an active felony warrant for escape at the time of his arrest and he is a habitual offender for driving while his license is suspended. He was on community release and under the supervision of Department of Corrections.
